Security Arrangements in the High Court, effective 18 October 2010

During the hearings in the High Court of the confirmation case relating to the 26/11 terrorist attacks, additional security restrictions will be in place. Members are requested to note the following:

Note that the arrangements for lawyers, their staff and litigants mentioned in the previous mail were decided late in the afternoon on Saturday, 16 October 2010 and, therefore, this circular should be read as having been slightly modified by that later decision.

The High Court Administration has framed and approved certain Guidelines for security during the Hearing of Confirmation Case relating to 26/11 Terrorist Attack. The said Guidelines are framed for the betterment & security of the members of our Association, High Court Staff and the Litigants.

Members are requested to follow the instructions and co-operate.

### Guidelines

  1. Hearing will be in Court Room No.49. It has a sitting capacity of 80 persons.
  2. List and other details of advocates who are representing the State and the accused will be prepared and they would be supplied to D.C.P. (Security). Rest of the seats meant for Advocates (30) would be allowed to be occupied by the Advocates on verification of their identity and on first come first basis.
  3. 40 Press/Media staff would be allowed entry. Their list will be prepared and approved by the Registry in consultation with the Deputy Commissioner of Police-in charge security and the representative of the Press. They would be provided passes signed by the Registrar (Judicial-I).
  4. 10 Police staff identified by the DCP-incharge security would be inside the Court Room. The location where they would sit would be finalized by the DCP-incharge security.
  5. No public/litigants except mentioned at Sr.No.3 would be allowed in the Court Room No.49. 6. For the entry of litigants in the Court premises, the pass system would be introduced. 3-4 Counters would be commissioned to issue passes. Litigants will have to give their full name, sex, age, address, telephone number including mobile number, the purpose of visit, the case number in which they are litigants, name of the Advocate representing them and the telephone number of the Advocate. Similar system of issuing passes is followed in the Mantralaya. No passes will be issued after 4 p.m. 7. Except litigants, entry of the general public in the court premises would be barred.
  6. As far as possible, masonry work etc. carried out by the PWD will be stopped unless it is of urgent nature. All the members of the staff will be instructed to carry with them identity card. The vigil would be kept in all the offices of the High Court and security personnel would be allowed to ask for identity of the persons moving in the premises.
  7. The list of staff working in both the canteens will be supplied to the security personnel. They will be asked to carry with them photo identity card. Such cards will be signed by Registrar (Judicial-I).
  8. So long as the proceedings continue, no other judicial work will be transacted in Court Room No.49. The security personnel would be allowed to conduct due frisking and thorough checking of the vehicles of the Officers of the High Court and the Advocates.
  9. The vehicles of the Advocates which are in the vicinity of the High Court will be issued sticker in coordination with members of the Bar Association. 12. Litigants making entry in the Court premises will not be allowed to enter with the mobile.
  10. The Media, Lawyers, Police staff entering in Court Room No.49 will not be allowed to carry mobile with them.
  11. List of the Court staff entering in Court Room No.49 will be prepared and provided to the DCP-in-charge security.
  12. Outer limit for the litigants to stay in the premises shall be 5.30 p.m.

Additional arragements for lawyers and their staff (decided on Saturday, 16 October 2010)

  1. Members (advocates) must show some photo identification and a membership card of the Bar Council/Bar Association/HC (OS) Library. Association staff are to be available to identify members, if the need arises. Advocates’ staff must have an authorisation letter and a photo-id.
  2. Advocates’ staff are (presumably/probably) not allowed to carry their cell phones into court.

Again, members should allow enough time to get through security.
