Pursuant to the requisition received from members regarding the administration of Justice, an Extraordinary General Meeting has been convened on Thursday, December 9, 2010 at 5.00 p.m. at the Association premises to consider and, if thought fit, to pass, with or without modification the following resolution proposed by the requisitionists:
“Resolved hereby to call upon the Honourable the Chief Justice of India to appoint a panel of five judges from amongst the judges of the Supreme Court of India and the High Courts to draft a model law for the appointment, disciplining and removal of judges of the Supreme Court and High Courts and for that purpose to consider the following:
- amending the Constitution of India to provide for the formation of a National Judicial Commission comprising i) the Prime Minister of India ii) Chief Justice of India iii) two senior most judges of the Supreme Court of India iv) Leader of the opposition in the Lok Sabha for the appointment of judges to the Supreme Court and High Courts.
- to consider amendments to the Constitution of India to enable Parliament to pass a comprehensive legislation providing for penalties short of removal for judges of the Supreme Court of India and High Courts
- to study the feasibility of the National Judicial Commission investigating complaints against judges of the Supreme Court of India and the High Courts and to recommend minor penalties as also their removal without in any manner compromising the supremacy of Parliament to remove judges of the Supreme Court of India and the High Courts as set out in article 124 of the Constitution of India.”
